Terms of Service

These Terms govern your use of OwnHealth.FIT. Please read them carefully — particularly the medical disclaimer in Section 4.

1. Acceptance

By accessing or using OwnHealth.FIT (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of service

OwnHealth.FIT is a health and performance optimization platform that enables individuals and coaches to track nutrition, training, sleep, body metrics, laboratory results, and personal protocols including peptides, supplements, and other compounds. The Service includes coaching tools, progress tracking, AI-assisted research features, laboratory ordering (where live and available in your jurisdiction), and related functionality.

3. Eligibility and account registration

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. You agree to provide accurate account information, keep your password secure, and accept responsibility for activity under your account.

You may access the Service as an individual user, as a member of a coach's team via invitation, as a coach, or as an administrator with appropriate permissions.

4. Medical disclaimer — read carefully

OwnHealth.FIT is not a medical provider. The Service does not provide medical advice, diagnosis, or treatment.

Information provided through the Service — including educational content, AI-generated responses, research articles, laboratory result displays, recommended protocols, and any commentary from your coach — is for informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment from a licensed physician or qualified healthcare provider.

Always consult a qualified healthcare provider before:

  • Starting, stopping, or changing any medication.
  • Starting, stopping, or changing any supplement, peptide, hormone, or other compound.
  • Acting on any laboratory result.
  • Changing a training or nutrition program if you have a medical condition.
  • Making any health decision based on information obtained through the Service.

Do not use the Service in an emergency. If you are experiencing a medical emergency, call 911 (in the United States) or your local emergency number immediately.

Coaches using the Service are not licensed medical providers (unless they independently hold such licensure and are acting within the scope of that license). Coaching relationships are fitness and lifestyle services, not medical care.

When our laboratory integration is live, you may order laboratory tests through the Service. These tests are authorized by a licensed physician in our partnered network for eligibility and safety screening. Results are delivered to you as raw data with general reference ranges. Interpretation and clinical decision-making are your responsibility, in consultation with your own healthcare provider.

The Service may reference, display information about, or allow tracking of compounds that are regulated, prescription-only, or otherwise restricted in your jurisdiction. Inclusion of a compound in the tracking catalog is not an endorsement, recommendation, or offer to sell. You are solely responsible for obtaining, possessing, and using any compound lawfully.

5. User content and conduct

You retain ownership of the content you submit to the Service (protocols, journal entries, photos, lab results, messages, meals, workouts, etc.). You grant us a non-exclusive, worldwide, royalty-free license to use that content solely to operate and improve the Service on your behalf, including to display it to you, share it with your coach as you direct, and process it through our integrations.

You agree not to submit content that:

  • Is unlawful, fraudulent, or infringes the rights of others.
  • Constitutes harassment, threats, or abuse of other users or staff.
  • Contains malware or attempts to compromise the Service.
  • Impersonates another person.
  • Is obscene, defamatory, or violates generally accepted standards.

We may remove content that violates these Terms.

6. Coaching relationships

If you are a coach, you are responsible for your interactions with members on your team, for the accuracy of protocols you recommend, and for compliance with any applicable professional licensing requirements in your jurisdiction. Coaches must not represent themselves as medical providers unless they are licensed as such.

If you are a member on a coach's team, you acknowledge that your coach will have access to your data as described in the Privacy Policy. You may leave a team at any time; past data shared with your coach remains on their team record unless you request deletion.

OwnHealth.FIT is not a party to coaching agreements between coaches and members. We do not set coaching prices, deliverables, or expectations, and we are not responsible for disputes between coaches and members regarding coaching services. When billing is enabled, we may facilitate payments between members and coaches, but the coaching relationship itself is between the coach and the member.

7. Connected services

The Service integrates with third-party providers (Withings, Oura, and others). Connecting a third-party service authorizes us to receive data from that service as described in the Privacy Policy. Your use of third-party services is governed by their own terms and privacy policies.

We are not responsible for the availability, accuracy, or operation of third-party services. If a third-party service changes its API, terminates its service, or otherwise becomes unavailable, integration features may stop working.

8. AI-generated content

The Service uses artificial intelligence to generate research-style responses, insight reports, and lab-result extraction. AI outputs:

  • Are generated by language models, not by humans.
  • May contain errors, omissions, or outdated information.
  • Are not medical advice.
  • Are not guaranteed to be accurate, complete, or appropriate for your situation.

Do not rely on AI outputs for medical, legal, financial, or other professional decisions. Verify important information with qualified professionals.

9. Laboratory services

When available in your jurisdiction and enabled, the Service allows you to order laboratory tests through our partnered clinical laboratory. By placing an order:

  • You certify that you are ordering the test for yourself (or for a minor you are legally responsible for, subject to eligibility rules).
  • You authorize our partnered physician network to review your order for eligibility and safety, in accordance with state requirements.
  • You understand that abnormal results may require follow-up with a licensed healthcare provider, and that neither OwnHealth.FIT nor the physician who authorized your test is your treating physician.
  • You acknowledge that laboratory tests have inherent limitations, false positive and false negative rates, and that results are one input into health decisions, not a complete picture.

Laboratory orders and results are handled in accordance with HIPAA and applicable state laws. See the Privacy Policy for details.

10. Purchases, subscriptions, and billing

When billing is enabled, the Service offers subscription plans at various tiers. By subscribing, you authorize us or our payment processor to charge your payment method on a recurring basis (monthly or annually as selected). Subscriptions renew automatically until canceled.

You can cancel your subscription at any time in your account settings. Cancellation takes effect at the end of your current billing period; you will retain access until then. We do not generally provide refunds for partial billing periods, except where required by law.

Laboratory tests and one-time purchases are billed per transaction. Refund policies for laboratory tests depend on test status: tests that have been processed cannot be refunded; tests that have been ordered but not yet collected may be refundable subject to our lab partner's policies.

Taxes, where applicable, are added to your total at checkout. You are responsible for any taxes owed on your subscription or purchases.

If your payment fails, we may suspend access until payment is received. We may change subscription pricing with at least 30 days' notice before your next renewal.

11. Supplements and products

Where the Service makes supplements or related products available for purchase, either directly or through third-party sellers:

  • Statements about these products have not been evaluated by the Food and Drug Administration unless explicitly stated.
  • Products are not intended to diagnose, treat, cure, or prevent any disease.
  • You are responsible for checking ingredients against your allergies, medications, and health conditions before consuming any product.
  • Third-party sellers are solely responsible for products sold by them; we are not a party to those transactions.

12. Intellectual property

The Service, including its design, code, text, graphics, and logos, is owned by OwnHealth.FIT and its licensors and is protected by copyright, trademark, and other laws. You receive a limited, non-transferable license to use the Service for personal, non-commercial purposes, and (for coaches) a limited license to use the Service for your coaching business.

You may not: copy, modify, distribute, sell, lease, or reverse-engineer any part of the Service; remove copyright or proprietary notices; use the Service to build a competing product; or use automated means to scrape, harvest, or extract data from the Service.

Exercise library content is licensed from third-party providers (including ExerciseDB) and is subject to their respective terms. USDA FoodData Central content is in the public domain but carries a request for source attribution, which we honor.

13. Acceptable use

You agree not to:

  • Use the Service in violation of any law.
  • Interfere with or disrupt the Service or servers.
  • Attempt unauthorized access to any account, system, or data.
  • Use the Service to distribute spam, malware, or harassing content.
  • Use the Service to provide medical diagnosis or treatment without appropriate licensure.
  • Resell access to the Service without authorization.
  • Misrepresent your identity or affiliation.

14. Termination

You may terminate your account at any time via your account settings or by contacting us.

We may suspend or terminate your access if we reasonably believe you have violated these Terms, created risk to the Service or other users, or for extended inactivity. We will generally give notice unless immediate action is necessary.

On termination, your license to use the Service ends. Data retention is governed by the Privacy Policy.

15. Disclaimers and limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, OwnHealth.FIT and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless OwnHealth.FIT from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of the rights of a third party.

17. Dispute resolution and governing law

These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles.

17.1 Informal resolution first

Before starting a formal dispute, you and OwnHealthFit, LLC agree to try in good faith to resolve the dispute informally for at least sixty (60) days. Informal resolution starts with written notice to the other party describing the nature and basis of the claim and the specific relief sought. You may send notice to us at legal@ownhealth.fit; we will send notice to you at the email address on your account. Most disputes can be resolved at this stage without formal proceedings.

17.2 Binding arbitration

If the dispute is not resolved within 60 days of notice, you and OwnHealthFit, LLC agree that any dispute arising out of or relating to these Terms or the Service — except for the matters excluded in Section 17.4 — will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. Arbitration will be conducted by a single arbitrator. The arbitration will take place in St. Tammany Parish, Louisiana, or, at your election, by telephone, videoconference, or written submissions. The arbitrator's award is final and may be entered as a judgment in any court of competent jurisdiction.

17.3 Class-action waiver and jury-trial waiver

You and OwnHealthFit, LLC each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or any other representative proceeding. Disputes must be brought individually. If a court of competent jurisdiction rules the class-action waiver unenforceable for a particular claim, that claim (and only that claim) will be severed from the arbitration provision and resolved in court under Section 17.5; the remaining claims will proceed in arbitration.

17.4 Excluded matters

Notwithstanding Section 17.2, either party may bring (a) an individual action in small-claims court within that court's jurisdictional limits, and (b) an action in any court of competent jurisdiction to seek injunctive or other equitable relief for infringement of intellectual-property rights or unauthorized access to, or misuse of, the Service.

17.5 30-day opt-out

You may opt out of the arbitration and class-action waiver provisions in Sections 17.2 and 17.3 by emailing legal@ownhealth.fit within thirty (30) days of first accepting these Terms (or within thirty (30) days of any material amendment to those sections). Your email must include your name, the email address associated with your account, and a clear statement that you are opting out of arbitration. Opting out will not affect any other provision of these Terms.

17.6 Venue for non-arbitrable matters

For any dispute that is not subject to arbitration — because it falls within Section 17.4, because you opted out under Section 17.5, or because arbitration is held unenforceable for that dispute — you and OwnHealthFit, LLC consent to the exclusive jurisdiction of the state and federal courts located in St. Tammany Parish, Louisiana, and waive any objection to venue in those courts.

18. Changes to the terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date. Material changes will be communicated by email or in-app notice. Continued use after changes constitutes acceptance.

19. General provisions

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and OwnHealth.FIT regarding the Service.
  • Severability. If any provision is unenforceable, the remaining provisions remain in effect.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale.
  • Force majeure. We are not liable for failures to perform caused by circumstances beyond our reasonable control.
